Fargo, ND (WDAY TV) - Marijuana might soon be illegal under state and city law in Fargo. A Marijuana and paraphernalia ordinance is on tonight's Fargo city commission agenda.
The move would free up county resources, transferring responsibility for prosecuting pot offenses from the state, to the city. The city attorney who drafted the ordinance says it's nearly identical to North Dakota's marijuana laws, but would downgrade the paraphernalia charge from a Class A misdemeanor, to a class B.
If passed, the ordinance will give police officers more discretion when citing, and might save an offender jail time.
Jason Loos - Fargo Assistant City Attorney: "Whenever they arrest someone for charges in district court, they need to book them in the jail. City court typically allows them to cite and release."
A second reading will be held two weeks from now if consent is given at tonight's meeting. If it's approved then, it would most likely become law that week.
